1. Who we are

FleetCommand is operated by DestiCab cc ("DestiCab cc", "we", "us", "our"). By creating an account or continuing to use the service, you enter into a contract with DestiCab cc and agree to these Terms & Conditions.

2. Acceptance

By accessing or using FleetCommand you agree to be bound by these terms. If you use the service on behalf of a company or organisation, you confirm you have the authority to bind that organisation; otherwise you confirm you are of legal age to enter into this agreement.

3. The service

FleetCommand is a fleet management platform providing daily quota tracking, shift reconciliation, odometer and receipt capture (including AI-assisted readings), maintenance scheduling, expense logging, and security alerts for ride-hailing and taxi fleets.

FleetCommand is an administrative record-keeping tool only. It does not supervise, employ, dispatch, insure, or control any driver or vehicle. Automated AI/OCR readings are estimates; the fleet owner is solely responsible for verifying every figure.

4. Acceptable use — no misuse

You must not misuse the service. This includes, without limitation: (a) any unlawful use; (b) fraud, spam, or deceptive practices; (c) infringing intellectual-property rights; (d) introducing malware, probing or scanning systems, or scraping the service; (e) attempting to circumvent security controls, quotas, or technical limits; (f) reverse engineering, reselling, or redistributing the service.

You are responsible for the lawfulness of driver monitoring, GPS tracking, and photographic capture performed through the platform in your jurisdiction, and for obtaining your drivers' consent.

5. Accounts and credentials

You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Fleet owners are responsible for the drivers they add.

6. Intellectual property

DestiCab cc retains all ownership of the service and its intellectual property, including the software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the service within your selected plan.

You retain ownership of the data and content you upload. You grant us a limited licence to host and process that content solely to provide the service to you.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at https://www.paddle.com/legal/checkout-buyer-terms. Subscriptions renew monthly until cancelled.

8. Service level

The service is provided "as-is" and "as available". We do not guarantee uninterrupted, timely, or error-free performance, and disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

9. Liability

To the fullest extent permitted by law, DestiCab cc is not liable for any indirect, consequential, or special damages (including loss of profits, data, or goodwill), nor for driver actions, vehicle accidents, traffic violations, financial miscalculations, uncollected revenue, or disputes between fleet owners and drivers. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim.

Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

10. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your access ends; you may request an export of your data within 30 days, after which it may be deleted.

11. General

These terms are governed by the laws of the Republic of Namibia. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control.
